Federal judge rules against city and Embankment Coalition

According to news reports, a federal judge issued a ruling last month that the city and groups fighting to preserve the Sixth Street Embankment in downtown Jersey City had no legal standing in seeking to reverse the 2005 sale of the Embankment to New York real estate investor Steve Hyman.
The groups claimed that the Embankment was not properly abandoned in keeping with federal law that required notifications to public entities before the historic railroad land was sold for $3 million to a private developer.
But U.S. District Judge Ricardo Urbina, in a 31-page ruling, ruled that the parties involved in the Embankment preservation had no reason to worry about immediate demolition by Hyman since he has been denied permits to do so, and said the city was notified three years before the sale to Hyman that Conrail had intended to sell the Embankment.
