UC employee plans to appeal decision regarding expunged conviction

UNION CITY — A Union City employee plans to submit an appeal to the appellate division this week regarding Hudson County Superior Court Judge Bernadette De Castro’s ruling Nov. 16 that Mayor Brian Stack had the right to consider firing the employee based upon an expunged conviction, according to a story on nj.com.
The Nov. 16 ruling marked the third time that the court determined that the privacy rights of Francisco Nunez, 40, were not violated when the expunged conviction for a weapons offense was raised during a city arbitration hearing, according to the article.
Nunez initially filed a grievance against the city in 2005 after they denied him a vacation request the year before.
Nunez, a bilingual clerk with the city since 1989, was never fired despite the various proceedings.
