EZPass may not be legal

NJSA (New Jersey Statutes Annotated) 39:3-74 says, “No person shall drive any motor vehicle with any….non-transparent material upon the front windshield…”

It has been pointed out that because the EZPass transponder is mounted on the front windshield above the rearview mirror in accordance with the instructions from the EZPass consortium, such vehicle owners are violating traffic laws (the title 39 series).

One might also conclude that the EZPass consortium, in its mounting instructions, is urging motorists to violate the law.

Of course, it is not necessary to mount the transponder on the front windshield.

The transponder works perfectly well if placed: 1. On the front seat; 2. On the dashboard; 3. In the glove compartment. Its placement on the front windshield is a matter of (in)convenience.
