Ramos-sponsored legislation banning unsolicited texts moves forward
Hoboken Assemblyman Ruben Ramos Jr.’s proposed legislation prohibiting unwelcome and unsolicited advertisements as text messages has been approved by an assembly panel. Bill A-1218 would prohibit unsolicited advertisements by text if they cost the cell phone user additional charges or reductions in their cell plans’ usage minutes.
The bill, approved in a 4-0 vote by the Assembly Consumer Affairs committee, now goes before the full Assembly.
“The growing number of complaints regarding unwanted text advertisements can no longer be ignored,” said Ramos in a release. “Cell phone users deserve basic protections against business practices that cause headaches and cost them money.”
The proposed law would prohibit companies from sending text ads to cell customers unless they give express consent, and would allow cell phone customers to cancel an advertiser’s texting privileges at any time. Violators would be punished under the state’s consumer fraud act with fines up to $10,000 for a first offense and up to $20,000 for subsequent offenses. Isolated messages, such as one text sent in a 12 month period, would be exempt.
