Motor vehicle stop leads to gun, drug charges

Bronx resident Angel Farias, 26, was arrested for alleged possession of a handgun and drugs last Friday, according to Guttenberg police.
On Nov. 26 at 9:15 p.m., Farias was charged with unlawful possession of a .9 mm handgun with 14 rounds and no permit on his person, possession of a weapon for unlawful purpose, possession of a weapon while distributing a controlled dangerous substance (CDS), distributing CDS, possession of CDS – 11 bags of white powder alleged to be cocaine or crack and several bags of alleged marijuana – and distributing CDS within a school zone, said Capt. Joel Magenheimer. Police said Farias also had $1,200 cash and four cell phones.
Magenheimer said Officer Franco DeLucio conducted a routine motor vehicle stop on 70th Street because Farias allegedly drove through a stop sign. After asking him for his license and registration, he says he detected “a strong odor of marijuana coming from the vehicle,” according to police.
After asking Farias to step out of the vehicle, DeLucio saw a clear “glassine bag” filled with what is alleged to be marijuana on the front seat of the car. During a police frisk, a silver-colored handgun with a high capacity clip was confiscated, police said.
A further search found $900 in cash and other alleged CDS hidden in a shoe, said Magenheimer.
Bail for Farias was set at $75,000 with no 10 percent option.
“Officer Franco DelLucio did an outstanding job, very professionally handled, with nobody hurt or killed,” said Magenheimer. “Anytime a gun is off the streets it is a good thing.”

Duo arrested for alleged assault, robbery

Jonathan Rodriguez, 22, and Christian Mejia, 19, both of North Bergen, were charged with aggravated assault and robbery after they were witnessed allegedly attacking two North Bergen victims and allegedly stealing their cell phones.
According to Magenheimer, on Nov. 20 at 12:40 a.m., police were called to 68th Street and Polk Street after a witness called police and said around eight males were allegedly punching and kicking two male victims on the ground.
Police found two of the alleged perpetrators who fit the description, Rodriguez and Mejia, in the area of 65th Street and Kennedy Boulevard.

‘I live [in jail] anyway’

Freddy Rodriguez, 21, of North Bergen was charged with disorderly conduct, two counts of aggravated assault on a law enforcement officer, and resisting arrest, according to Commander of the Detective Bureau Lt. Frank Cannella.
Cannella said that Rodriguez, along with others who were a part of a large group, was outside of a grocery store at 2 a.m. on Nov. 28 when the owner stopped a police officer and asked him to disperse the crowd.
Police said that everyone left, but that Rodriguez allegedly flailed his arms and said, “Why the [expletive] do I have to leave. [expletive] you.”
Cannella said that as police explained why he had to leave, he allegedly became “more belligerent and confrontational.” Told he was being placed under arrest, he allegedly told police to take him to jail because “…I live there anyway.”
As he was being placed in the police car by two officers, he allegedly tried to kick them and missed, and his face reportedly came into contact with the divider in the car, causing a laceration above his right eyebrow. After being transported to headquarters, he eventually let North Bergen E.M.S. treat him for his injuries.
He was given $2,500 bail with a 10 percent option by Judge Nino Falcone.

DWI checkpoint leads to 105 tickets

A DWI checkpoint North Bergen Police conducted the night before Thanksgiving from 9 p.m. until Nov. 25 at 4 a.m. ended in one DWI, arrests for five outstanding warrants, nine vehicles towed, and the issuance of 105 summonses, according to Cannella. The checkpoint was set up at 43rd Street and Kennedy Boulevard.
Oscar Guallpayuvi Gustabo, 21, of Plymouth, Mass. was arrested for DWI at 12:20 a.m. on Nov. 25, said Cannella. After being stopped and interviewed in his 2005 two-door Honda, police noticed a strong odor of an alcoholic beverage allegedly on his breath.
Cannella said Gustabo was unable to pass a field sobriety test and had a Blood Alcohol Concentration (BAC) of 0.07 percent, which was .01 percent under the legal limit, but police said that he was still charged, his car was impounded, and he was released on a summons.
Cannella said that police noticed Tomas Moreiro, 37, of Union City, make a U-turn in front of the checkpoint at 2:45 a.m. After he was stopped for allegedly trying to avoid it, police learned that he had an outstanding $1,000 warrant from North Bergen due to an excessive noise complaint from 1993.
After being transported to headquarters, police found what they allege to be cocaine wrapped in a $5 bill on his person. He was charged with possession of a controlled dangerous substance.
Judge Falcone set his bail at $5,000 with a 10 percent bail bond option, in addition to the previous North Bergen warrant and an outstanding $200 warrant from Union City.
